Biopatents are patents pertaining to life forms excluding microorganisms. This field of patent is in a very nascent stage whereby a stiff conflict goes on between developed and developing countries. Biopatents are a means to develop disease resistant varieties of plants, animals and genetic improvement of human beings whereby strong progenies may be born in future. The TRIPS agreement has provided for a balancing approach whereby the developing countries are given freedom to incorporate the terms of the agreement in their laws within definite time frame. The book casts a balancing approach protecting the rights of both author and public so that the hard earned money and labour of the inventor does not go in vain and much more health benefits can be availed while balancing biopatents with ethics, human rights and ownership issues making biopatents an epitome of success.
