The pursue of complete decentralization is currently not convincing in every respect. Problems with regard to enforceable liability claims and tangible liability subjects have hardly been considered to date. The global involvement of regulatory authorities with the construction of possible addressees of supervisory regulations also shows the existing need for clarification. The thesis is dedicated to these specific problems. In addition to the development of a regulatory concept under supervisory law, civil law problems are mainly solved using the existing legal basis.

Autorenportrait

Kira Franke completed her legal training in Hesse. After studying at the Philipps University in Marburg (2016-2021), she worked at the Institute for the Law of Digitization under Prof. Dr. Sebastian Omlor and completed her doctorate in November 2023. The doctorate is characterized by two short research stays in New York. Immediately after completing her doctorate, she went to Bocconi University (Milan, Italy) for a short comparative law research stay. Since September 2023, Kira Franke has been a trainee lawyer at the Higher Regional Court of Frankfurt.
